How ROI Consultants collects, uses and protects personal information, in line with the Protection of Personal Information Act 4 of 2013 (POPIA). Last updated: 30 August 2026.
Note: This document is a working draft prepared for ROI Consultants and has not yet been reviewed by a qualified attorney or Information Officer sign-off process. It should be reviewed before being relied upon as final.
ROI Consultants ("we", "us") operates the training and Skills Development Facilitator platform at roiconsultants.co.za. For the purposes of POPIA, ROI Consultants is the responsible party for employer account information, and acts as an operator on behalf of employer clients for employee personal information processed for skills development and compliance purposes.
2.1 Employer account information: company name, SDL number, registered SETA, SDF/HR contact name, phone number, and the account holder's name, email and password.
2.2 Employee information (added by your organisation via Manage Employees): full name, ID or passport number, job title, employment status, occupational level, remuneration tier, OFO code, NQF level, learning path, and course completion records.
2.3 Special personal information (as defined by POPIA): population group, gender, and disability status. This is collected only because the B-BBEE Codes of Good Practice and Employment Equity Act specifically require this demographic reporting for skills development scorecard purposes, and only with the consent your organisation confirms was obtained from the employee at the point of enrolment.
2.4 Evidence documents uploaded for external training records under Manage WSP & ATR, such as certificates and attendance registers.
General employee information is processed on the basis of our contract with your organisation and our legitimate interest in providing the Service. Special personal information (population group, gender, disability status) is processed only on the basis of the employee's consent, which your organisation confirms at the point of adding that employee to the platform, and which is a mandatory, logged step in our enrolment process.
5.1 Where we act as your appointed SDF, relevant training records are shared with your SETA as part of your WSP/ATR submission, as required by law.
5.2 We share information with service providers who help us operate the platform, including our hosting provider and payment gateway, under contractual confidentiality obligations. We do not sell personal information to third parties.
5.3 We may disclose information where required by law, court order, or to protect the rights, property or safety of ROI Consultants, our users, or others.
We apply reasonable technical and organisational measures to protect personal information against loss, unauthorised access, and disclosure, including access controls restricting employee compliance data to the employer who added it and authorised ROI Consultants staff.
We retain employee compliance information for as long as your subscription is active and for a reasonable period afterward to meet SETA record-keeping requirements, after which it is deleted or anonymised unless a longer retention period is required by law.
Under POPIA, employees whose information we process have the right to request access to their personal information, request correction or deletion of inaccurate information, object to processing on reasonable grounds, and lodge a complaint with the Information Regulator. Requests relating to employee data should generally be directed to the employing organisation, who can contact us to action them on the employee's behalf.
Our website uses essential cookies required for login sessions and basic site functionality. See our Cookie Policy for further detail.
Where any of our service providers process information outside South Africa, we take reasonable steps to ensure equivalent protection is in place, consistent with POPIA's requirements for cross-border transfers.
If you believe your personal information has been processed unlawfully, you may lodge a complaint with the Information Regulator of South Africa (inforeg.org.za).
We may update this Privacy Policy from time to time. Material changes will be communicated to active subscribers by email or in-platform notice.
Questions about this Privacy Policy, or requests relating to personal information, can be directed to us via our Contact page.
